Inherited the house? Start with selling an inherited house in Delaware. Is it a rental? See we buy rentals with tenants in place.
Can you get an offer without visiting the house?
Yes. I'm based in Wilmington, so I can do the walkthrough for you. Most out-of-state owners do one of these:
- Have a neighbor, relative, property manager or agent let me in, or use a lockbox.
- Send photos and a short phone video; I'll follow up with a walkthrough before the offer is final.
- Join a video call while I walk the house, so you see what I see.
You get the same written offer with the math as any seller: after-repair value, repairs, costs and margin.
How does a remote or mail-away closing work in Delaware?
Delaware sales close at a licensed Delaware settlement attorney; Maryland and Pennsylvania sales close at a licensed title company or settlement attorney. That office decides how documents get signed, so ask them early. The usual options:
| Option | How it works | Good to know |
|---|---|---|
| Mail-away closing | The settlement office sends the deed and closing papers. You sign in front of a notary where you live and courier the originals back. | Delaware gives a notarial act performed in another state the same effect as one done here (29 Del. C. §4324). Use the office's instructions exactly; a missing seal or wrong name delays recording. |
| Remote online notarization | A Delaware notary registered for remote notarization verifies your identity and watches you sign over a live audio-video session. | Allowed since Delaware's Revised Uniform Law on Notarial Acts (SB 262) took effect August 1, 2023. Not every settlement office offers it; extra rules apply if you're outside the U.S. |
| Power of attorney | Someone you trust signs for you under a power of attorney. | The settlement office has to approve the form in advance, and it's typically recorded with the deed. Never sign a power of attorney for a buyer. |
Your proceeds are paid by wire. Confirm the wire instructions by calling the settlement office at a number you looked up yourself; wire fraud targets remote sellers. Report any attempt to your bank and the FBI's IC3.
What taxes apply to a nonresident seller?
| Where the house is | Nonresident withholding |
|---|---|
| Delaware | Estimated tax is filed with form REW-EST before the deed is recorded and withheld from your proceeds: 6.6% of the gain for individuals. Exemptions include gain excluded under the federal home sale exclusion (IRC §121). It's a credit against your Delaware return. |
| Maryland (Elkton, Cecil County) | 8.75% for individuals and 8.25% for entities on sales after June 30, 2025, unless an exemption applies. |
| Pennsylvania (Chester, Upper Darby) | Ask the title company early about any nonresident requirements and local transfer taxes, which vary by municipality. |
Withholding isn't the final tax; you settle up when you file. Tell the settlement office you're a nonresident the day you sign, so the forms don't hold up recording. More detail: capital gains on a Delaware home sale.
How do you look after a vacant house from another state?
- Insurance: most homeowners policies have a vacancy clause that limits coverage after the house sits empty for a set period, often 30 to 60 days. Call your insurer now.
- Wilmington vacant registration: a property vacant 6 consecutive months must be registered, and the annual fee climbs from $500 in year two to $12,000 a year by year five. See selling a vacant house.
- Wilmington rentals: if you live outside New Castle County and rent the house, the city requires a licensed property manager.
- Winter: keep the heat on low or have the plumbing winterized; a burst pipe in an empty house can run for weeks.
- Eyes on the house: a neighbor with your number, lights on timers, mail stopped, grass cut. Code complaints in New Castle County can end up on the tax bill.
Can you handle Delaware probate from another state?
Yes. A nonresident can serve as personal representative of a Delaware estate, but must first file an irrevocable power of attorney with the Register of Wills naming the Register as agent for service of process (12 Del. C. §1506). Court of Chancery Rule 190 says the personal representative doesn't have to appear in person at the Register's office when represented by a Delaware attorney. Until letters are issued, no one has authority to sell, but we can agree on terms early and close once the authority is in place.
Read Delaware's Register of Wills offices, the probate process for a house, and, if family members disagree, when heirs disagree.
How do we work with out-of-state owners?
- I handle the walkthrough, and the contractors or cleaners who need access before closing.
- We buy as-is, including what's left in the house. Take what you want; we handle clean-out after closing.
- Everything is in writing: the offer, the math and the settlement statement, sent by email so you can review it with family.
- You pick the date. Most sales close in 10 to 60 days.

Do I have to come to Delaware to sell my house?
Usually not. Most out-of-state owners sign by mail-away closing before a local notary or by remote online notarization, as arranged by the settlement attorney.
Does Delaware allow remote online notarization?
Yes. Since August 1, 2023, a Delaware notary registered for remote notarization can notarize for a remotely located signer by live audio-video (29 Del. C. §4320). Ask the settlement office whether it offers this.
Will Delaware accept a deed notarized in another state?
Yes. A notarial act performed by a notary of another state has the same effect under Delaware law (29 Del. C. §4324).
How much tax is withheld when a nonresident sells Delaware property?
Individuals generally have 6.6% of the gain withheld through form REW-EST, unless an exemption such as the home sale exclusion applies. It is credited against your Delaware return.
Can I be executor of a Delaware estate if I live in another state?
Yes. A nonresident personal representative must file an irrevocable power of attorney with the Register of Wills designating the Register as agent for service of process (12 Del. C. §1506).
