What is the difference between a small estate and a regular estate in Maryland?
A Maryland small estate is one worth $50,000 or less, or $100,000 or less when the surviving spouse is the only heir or legatee. Real property counts, at fair market value less debts secured by it. Larger estates go through regular administration, with publication, an inventory and accounts.
The limits are in Estates & Trusts §5-601. The Register of Wills' information guide explains that small-estate value is the fair market value of property less debts of record secured by it, so a house with a large mortgage can sometimes fit. Most houses in Cecil County will put an estate over the limit.
| Step | Regular estate | Statute |
|---|---|---|
| Notice of appointment published | Once a week for 3 successive weeks | §7-103 |
| Inventory | Within 3 months after appointment | §7-201 |
| First account | Within 9 months from appointment | §7-305 |
| Creditor claims | Earlier of 6 months after death or 2 months after notice to the creditor | §8-103 |
Some estates qualify for modified administration (§5-702): the election is made within 3 months of appointment, the estate must be solvent, the heirs must be limited to people exempt from inheritance tax, and a final report is due within 10 months.
Can a personal representative sell a house in Maryland without court approval?
Generally, yes. In Maryland, legal title to the decedent's property passes to the personal representative for administration, and the representative may sell property without court approval or ratification, unless the will or a court order limits that power. Heirs who disagree can still raise objections with the Orphans' Court.
See Est. & Trusts §1-301 (title to the personal representative) and §7-401 (powers, including to "sell" property). The settlement company will ask for the letters of administration, a copy of the will if there is one, and the deed. We could not confirm on an official page whether a small-estate representative needs Orphans' Court approval to sell real property, so ask the Register's office or an estate attorney if your estate is a small estate.
What taxes apply when an estate sells a house in Maryland?
Maryland has an inheritance tax of 10% on what passes to non-exempt heirs, such as nieces, nephews and friends; spouses, children and their descendants, parents and siblings are exempt. Maryland also has an estate tax, but only above a $5 million exemption. The sale itself carries state and county transfer taxes.
- Inheritance tax rate and exemptions: Tax-General §7-204 and §7-203; the Register's tax page adds registered domestic partners for deaths on or after Oct 1, 2023.
- Estate tax exemption: $5,000,000 for deaths on or after Jan 1, 2019 (§7-309).
- State transfer tax: 0.5% of the price (Tax-Property §13-203).
- Cecil County: recordation tax of $4.10 per $500 and a 0.5% county transfer fee (Cecil County Recordation & Transfer). When Silverside buys the house, we pay all closing costs, including the estate's share of the transfer and recordation taxes.
- Probate fees are charged on the estate's value when the first account is filed: $0 under $50,000, $100 from $50,000, $200 from $100,000 and $1,000 from $500,000 (§2-206).
If the estate or an heir is outside Maryland, the sale may also trigger nonresident withholding at settlement (Tax-General §10-912). The statute sets the rate by formula, and we could not confirm the current percentage on an official page, so have the title company confirm it before closing.
How long does it take to sell an estate house in Cecil County?
The sale can close once the personal representative is appointed and has letters, often well before the estate closes. Distribution to heirs waits on the creditor period and the accounts. A cash sale can close within weeks of a signed contract; a listing depends on condition and the market.
Practical steps: get certified copies of the death certificate, find the original will, contact the Register to schedule, then secure and insure the house. Keep paying property taxes, insurance and utilities from estate funds where possible, and keep receipts for the account.
Where does a direct buyer fit in a Maryland estate sale?
For heirs who live far away or a house that needs work, a direct buyer can purchase as-is, take the contents, and close on a date that suits the estate. The personal representative signs, and the title company pays any liens and taxes from the proceeds. If listing would net the estate more, we will say so.
