Not legal advice. Dates are the earliest the rules below allow, assuming each step happens as early as possible; real cases almost always take longer. Federal, state and court rules change, and your loan type (FHA, VA, USDA) or a bankruptcy can add steps. Rules checked October 11, 2026. Talk to a HUD-approved housing counselor or a lawyer about your case.

- Federal 120-day rule: 12 CFR 1024.41(f) and (g) (no first filing until more than 120 days delinquent; a complete loss-mitigation application more than 37 days before a sale blocks the sale).

C. §§ 5061 to 5062C (scire facias, 45-day Notice of Intent, loss-mitigation affidavit, automatic mediation: certificate of participation within 30 days of service, conference 45 to 75 days after service, no judgment before the day after the conference); 10 Del. C. § 4973 (sale posted 10 days before and advertised 2 weeks); Superior Court Civil Rule 69 (7 days' certified-mail notice; return of sale on the 3rd Monday of the following month, then confirmation). New Castle County holds real-estate sheriff sales on the 2nd Tuesday of each month (Sheriff's Office); its result lists say sales confirm on the Friday after the 3rd Monday of the following month. - Maryland: Md. Frequently asked questions
How soon can foreclosure start after a missed payment?
For most home loans, federal rules (12 CFR 1024.41(f)) bar the servicer from making the first foreclosure notice or filing until the loan is more than 120 days delinquent. State notice periods can push that later.
Is Delaware a judicial foreclosure state?
Yes. A Delaware mortgage foreclosure is a court case (scire facias sur mortgage) in Superior Court. Owner-occupied 1 to 4 unit homes get a Notice of Intent to Foreclose at least 45 days before filing and are automatically scheduled for mediation.
Is Maryland judicial or non-judicial?
Maryland foreclosures are filed in Circuit Court but usually run under a power of sale or assent to decree, so the court supervises without a full trial. Owner-occupied homes get a Notice of Intent to Foreclose and can request mediation.
How long does foreclosure really take?
Much longer than the legal minimums. ATTOM reported that homes foreclosed nationally in the second quarter of 2026 had been in foreclosure an average of 563 days. Court backlogs, mediation, loss-mitigation reviews and bankruptcy all add time.
Can I still sell my house during foreclosure?
Usually yes, until the sheriff or trustee sale, and a sale that pays off the loan ends the foreclosure. Talk to a HUD-approved housing counselor first; it is free.
